東京とうきょう渋谷しぶや区くの複合ふくごう施設しせつに展示てんじされていたネコのオブジェが無断むだんで異ことなるデザインに変更へんこうされたのは「著作ちょさく権けんの侵害しんがいにあたる」として作者さくしゃがオブジェを所有しょゆうする企業きぎょうに抗議こうぎしていたことが分わかりました

都内とないに住すむ現代げんだい美術びじゅつ作家さっかの吉田よしだ朗あきらさんは、大手おおて不動産ふどうさん会社かいしゃが渋谷しぶや区内くないに開発かいはつした複合ふくごう施設しせつのレストランに展示てんじするオブジェの制作せいさくを依頼いらいされました

Akira Yoshida, a contemporary artist living in Tokyo, was asked to create an object to be exhibited at a restaurant in a complex developed in Shibuya by a major real estate company.

吉田よしださんは招き猫まねきねこをモチーフとしたオブジェを完成かんせいさせ、2020年ねんから展示てんじされていましたが、その後そのご、ネコのデザインが突然とつぜん、黒くろを基調きちょうにしたものに無断むだんで変更へんこうされたということです

Mr. Yoshida completed an object with the motif of a beckoning cat, and it has been on display since 2020, but after that, the design of the cat was suddenly changed to a black-based one without permission.

吉田よしださんはSNSで初はじめてこのことを知しり、オブジェを所有しょゆうする企業きぎょうに対にたいして「作者さくしゃに無断むだんで姿すがたを変かえるのは著作ちょさく権けんの侵害しんがいにあたる」と抗議こうぎしたということです

Mr. Yoshida learned about this for the first time on SNS, and protested against the company that owns the object, ``It is an infringement of copyright to change the appearance without the permission of the creator.’’

その後そのご、オブジェは吉田よしださんのもとに、変更へんこうされたデザインのまま、返還へんかんされました

吉田よしださんは「このネコのオブジェは海外かいがいのお客おきゃくさんを意識いしきして、日本にっぽん的てきなイメージで赤あかと白しろを基調きちょうとしました

Yoshida said, ”This cat object was made with red and white as the base color to create a Japanese image, with overseas customers in mind.

設置せっちされる場所ばしょが渋谷しぶや駅えきのハチ公はちこう像ぞうと対たい角かくになるので、このネコも愛あいされる作品さくひんになってほしいという思おもいを込こめました」と振り返ふりかえります

そのうえで、デザインが無断むだんで変更へんこうされたことについては「なぜこんなことをするのかショックでした

オブジェを所有しょゆうしていた三井みつい不動産ふどうさんは、アーティストへの配慮はいりょを欠かく対応たいおうだったことを認みとめて、謝罪しゃざいしたということです

芸術げいじゅつ作品さくひんと著作ちょさく権けん法ほうに詳くわしい武蔵野むさしの美術びじゅつ大学だいがくの志田しだ陽子ようこ教授きょうじゅは「アートにはそれを購入こうにゅうした人ひとにも、無断むだんで改変かいへんすることはできない著作ちょさく者しゃ人格じんかく権けんという考え方かんがえかたがある
