軍事転用が可能な機械を不正に輸出した疑いで逮捕、起訴され、後に無実が判明した横浜市の化学機械メーカー「大川原化工機」の社長などが都と国を訴えた裁判で、2審の東京高等裁判所は5月、1審に続いて警視庁公安部と東京地検の捜査の違法性を認めるとともに「輸出規制の要件についての警視庁公安部の解釈は国際的な合意と異なり、合理性を欠いていた」などと指摘し、都と国にあわせて1億6600万円あまりの賠償を命じました。

検察の起訴追加捜査の不備を指摘
東京地方検察庁が社長ら3人を起訴したことについても違法だと判断しました。

大川原化工機の幹部などが、「機械に温度が上がりにくい部分があり、規制の対象ではない」と説明していることについて、検察も報告を受けていたとし、メーカー側の主張について実験などで確認すべきだったと指摘しました。

警視庁内部の受け止めは
起訴取り消し後の民事裁判で、国や都は「違法な捜査はなかった」という主張を続けてきました。
