Municipalities are required to make efforts to establish systems, through ordinances and other means, to review disaster-related deaths in preparation for applications from bereaved families. However, it has been found that more than half of the 139 municipalities expected to suffer significant damage from tsunamis have not set such regulations.
「災害関連死」は、地震や津波などから逃れて助かったものの、その後の避難生活による体調の悪化などが原因で亡くなることで、3月に見直された南海トラフ巨大地震の国の被害想定では、最悪の場合、5万2000人にのぼるとする推計が示されました。
Disaster-related deaths refer to cases where people survive earthquakes, tsunamis, or other disasters, but later die due to deteriorating health during evacuation life. In the revised national damage estimate for a Nankai Trough megaquake released in March, it is projected that, in the worst case, the number could reach as many as 52,000 people.
「災害関連死」にあたるかどうかは、遺族の申請を受けて医師や弁護士などで構成される審査会が判断しますが、国は手続きが滞らないよう市町村に対して審査会の設置について条例などで定めておくことを努力義務としています。
Whether a death qualifies as a “disaster-related death” is determined by a review board composed of doctors, lawyers, and others, based on applications from the bereaved families. The national government requires municipalities to make efforts to stipulate the establishment of such review boards in ordinances and other regulations, so that the process does not stall.
そこで、津波で甚大な被害が想定される「南海トラフ地震津波避難対策特別強化地域」に指定されている千葉県から鹿児島県にかけての14都県の139の市町村に取材した結果、51%にあたる71の市町村で審査会の設置に関する規定を設けていないことが分かりました。
As a result of interviews with 139 municipalities in 14 prefectures from Chiba to Kagoshima, which have been designated as Specially Strengthened Areas for Nankai Trough Earthquake and Tsunami Evacuation Measures where severe tsunami damage is expected, it was found that 71 municipalities, or 51%, do not have regulations regarding the establishment of review committees.
理由を複数回答で尋ねたところ、
▽「知識やノウハウの不足」が最も多く73%、
▽「職員の不足」が59%、
▽「関係部署と協議ができていない」が46%、
▽「専門家など審査会の担い手不足」が37%、などとなっています。
When asked for multiple reasons, the most common response was lack of knowledge or know-how at 73%, followed by shortage of staff at 59%, lack of coordination with related departments at 46%, and shortage of professionals or members for review committees at 37%, among others.
一方、準備を進めていると答えたのは2つの市で、残りの66の市と町は条例などで定めていましたが、すぐに手続きが進められるよう審査会の人選まで行っていたのは16の市と町にとどまりました。
On the other hand, only two cities responded that they were making preparations, while the remaining 66 cities and towns had established regulations, but only 16 of them had gone as far as selecting members for the review committee so that procedures could proceed immediately.
中には、条例で定めているにもかかわらず規定を設けていないと回答し、審査会の設置について把握していなかった自治体もあり、迅速に審査できるか不透明な実態も明らかになりました。
Some municipalities responded that, despite having regulations in place, they had not established the necessary provisions and were not aware of the establishment of a review board. This has revealed the reality that it is unclear whether reviews can be conducted promptly.
専門家 “がく然とする 市町村が主体となり準備進める必要”
「南海トラフ地震津波避難対策特別強化地域」に指定されている自治体の半数余りが、「災害関連死」の審査会の設置を条例などで定めていなかったことについて、東日本大震災で審査会の委員を務めた在間文康弁護士は「がく然とする」と述べるとともに、「審査を行うためのスタートラインに立てていない自治体が多いことは問題の深刻さを物語っている」と指摘しています。

Fumikou Aima, a lawyer who served as a committee member after the Great East Japan Earthquake, commented, I am stunned, and pointed out, The fact that many municipalities are not even at the starting line to conduct such reviews highlights the seriousness of the issue.
在間弁護士によりますと、準備ができていない中で、急ごしらえで出た結論は、適正に判断されたのか遺族に懸念を抱かせ大きな弊害になるおそれがあるということです。
According to lawyer Aima, there is a concern among the bereaved families that a hastily made conclusion without proper preparation may not have been judged appropriately and could cause significant harm.
このため、地元の市町村が主体となって、事前に審査会の委員を決め、年に1度程度集まる機会を設けて勉強会を開くなど、準備を進める必要があると指摘しています。
For this reason, it has been pointed out that local municipalities should take the lead in advance by appointing the members of the review committee, holding study sessions about once a year, and making other preparations.
そのうえで国に対しては、市町村をさらにバックアップする必要があるとしています。
On top of that, it is stated that the national government needs to provide further support to municipalities.

Attorney Arima said, The issue of disaster-related deaths could happen to anyone at any time.
